These Terms of Service (“Terms”) govern your access to and use of the SurfPal website, browser extension, related software, paid features, license services, and any associated services we provide (collectively, the “Service”).
The Service is operated by Mutacore Co., Ltd. (“Mutacore”, “we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
1. Use of the Service
You may use the Service only in compliance with these Terms and all applicable laws and regulations.
You are responsible for your own use of the Service and for ensuring that your use is lawful in your jurisdiction.
You agree not to:
- interfere with or disrupt the normal operation of the Service;
- attempt to gain unauthorized access to any part of the Service;
- bypass, disable, or interfere with any access control, license verification, or security feature;
- reverse engineer, decompile, or attempt to extract the source code of the Service, except where permitted by applicable law;
- use the Service for unlawful, harmful, fraudulent, or abusive purposes;
- share, resell, transfer, or sublicense any license key or paid access right without our written permission.
2. Account, License, and Paid Features
Some features of the Service may require a paid license.
A SurfPal Pro license grants you a personal, limited, non-exclusive, non-transferable, and revocable right to use the paid features of the Service, subject to these Terms and any usage limits described at the time of purchase.
Unless otherwise stated, a license is for individual use only. You may not share your license key with others, resell it, publish it, or use it in a way that exceeds the permitted device or usage limits.
We may suspend, revoke, or restrict a license if we reasonably determine that the license has been shared, abused, obtained fraudulently, used in violation of these Terms, or used in a way that harms the Service or other users.
3. Payments and Refunds
Prices, paid features, and payment methods may be displayed on our website, in the browser extension, or through third-party payment providers.
By purchasing a paid license, you agree to pay the applicable fees shown at the time of purchase.
Unless otherwise required by applicable law or expressly stated at the time of purchase, payments for digital licenses and paid features are non-refundable after the license has been delivered or activated.
If you believe a payment was made in error, or if you cannot access a paid feature after purchase, please contact us at support@mutacore.com.
4. Service Features and Limitations
SurfPal is designed to help users track website usage, manage browser screen time, block distracting websites, create plans, and improve awareness of online habits.
However, the Service does not guarantee that you will reduce screen time, improve productivity, stop visiting distracting websites, or achieve any specific behavioral, productivity, health, or lifestyle outcome.
You remain responsible for your own decisions, device usage, browsing behavior, and self-management.
The Service may not block all websites or all access methods. For example, users may still access content through other browsers, devices, applications, networks, or by uninstalling or disabling the extension.
5. Data, Privacy, and Local Storage
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, process, and protect data related to the Service.
SurfPal may store browsing duration records, settings, plans, license status, and related configuration data locally in your browser.
If you enable cloud backup or data synchronization, the Service may interact with third-party services such as Google Drive to back up or synchronize your data.
You are responsible for maintaining the security of your own devices, browser profiles, Google account, and any third-party accounts connected to the Service.
6. Third-Party Services
The Service may integrate with or rely on third-party services, including browser platforms, extension stores, payment providers, and cloud storage providers such as Google Drive.
Your use of third-party services is governed by their own terms, privacy policies, and technical requirements.
We are not responsible for the availability, security, functionality, policies, or actions of third-party services.
If a third-party service becomes unavailable, changes its API, restricts access, or modifies its terms, some features of the Service may stop working or require changes.
7. Intellectual Property
All content, branding, trademarks, logos, software, interfaces, designs, text, graphics, and other materials related to SurfPal are owned by Mutacore Co., Ltd. or its licensors and are protected by applicable intellectual property laws.
Except as expressly permitted by these Terms or applicable law, you may not copy, modify, distribute, sell, lease, sublicense, publish, create derivative works from, or otherwise exploit any part of the Service without our prior written permission.
These Terms do not transfer any ownership rights in the Service to you.
8. Feedback
If you provide suggestions, feedback, bug reports, feature requests, or other comments about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, publish, and incorporate that feedback into the Service without any obligation to compensate you.
9. Updates, Changes, and Availability
We may update, modify, suspend, or discontinue all or part of the Service at any time.
We may also add, remove, or change features, including free and paid features, for technical, legal, security, operational, or business reasons.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
10. Disclaimer
The Service is provided on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, reliability, availability, accuracy, and security.
We do not warrant that the Service will meet your expectations, prevent all unwanted browsing, operate without interruption, or be free from errors, defects, data loss, or security issues.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Mutacore Co., Ltd. and its directors, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, loss of goodwill, business interruption, or device or software issues arising from or related to your use of the Service.
To the fullest extent permitted by applicable law, our total liability for any claim arising out of or related to the Service will not exceed the amount you paid to us for the Service in the twelve months before the claim arose, or USD 50 if you have not paid us for the Service.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Mutacore Co., Ltd. and its directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, losses, damages, liabilities, costs, and expenses arising from or related to:
- your use or misuse of the Service;
- your violation of these Terms;
- your violation of applicable laws or regulations;
- your infringement of any third-party rights.
13. Termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate your access to the Service, including paid features or license services, if we reasonably believe that:
- you have violated these Terms;
- your use of the Service creates legal, security, operational, or reputational risk;
- your license has been abused, shared, resold, or obtained fraudulently;
- termination is required by law, regulation, platform policy, or third-party service requirement.
Termination does not affect any rights or obligations that have already arisen before termination.
14. Changes to These Terms
We may revise these Terms from time to time.
If we make material changes, we may provide notice through the Service, our website, email, or other reasonable means.
Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service.
15. Governing Law
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict of law principles.
For the purpose of these Terms, the laws of the People’s Republic of China do not include the laws of Hong Kong Special Administrative Region, Macao Special Administrative Region, or Taiwan.
16. Dispute Resolution
If a dispute arises from or relates to these Terms or the Service, you agree to first contact us at support@mutacore.com and attempt to resolve the dispute through friendly negotiation.
If the dispute cannot be resolved through negotiation, either party may submit the dispute to a court with competent jurisdiction in the People’s Republic of China, unless otherwise required by applicable law.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
The invalid, illegal, or unenforceable provision will be interpreted or replaced to the maximum extent permitted by law to achieve its original purpose.
18. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms presented to you for specific features or purchases, constitute the entire agreement between you and Mutacore Co., Ltd. regarding the Service.
